Abstract/摘要:This paper documents how historical Confucianism affects modern legal jurisdiction outcomes on corporate issues in China. By using a large proprietary database of court-level judgement transcripts, we find courts located in higher generalized morality places inherited by Confucianism positively contribute to the convergence of legal disagreements between corporate plaintiffs and defendants. This county-level Confucian culture on jurisdiction intensively helps to reach out lower polarity between two agents and extensively decrease the probability of second trail prosecutions. This cultural harmony also applies to the litigation risks of law violations. Further, compared with judgers, our channel tests show that the local political governance system and media governance make greater impacts on this positive relationship. Additionally, after receiving the judgement outcomes, local jurisdiction system with higher morality leads firm engaging more CSR issues such as donations and costing fewer financial resources such as cash spendings. Overall, different from western legal judgement systems, we show the morality of Confucianism can bring positive legal heritage to different agents in China and crucially reshape the social norms within a such centralized political system.
